5 Things You Should NEVER Say to the Insurance Company After an Accident

After an accident that wasn't your fault, the phone rings fast. On the other end is an adjuster from the at-fault driver's insurance company, friendly and eager to "help you wrap everything up quickly." Here's the truth we repeat to families in Eagle Pass, Laredo, and San Antonio at Gonzalez & Associates: that adjuster does not work for you. Their job is to pay as little as possible. What you say on that first call can reduce — or even end — your compensation. These are the 5 things you should never say.

1. "I'm fine" or "I'm not hurt"

It's the most natural thing to say, especially to keep from worrying anyone. But many injuries — whiplash, back strain, concussions — show up hours or days later. If you told the adjuster you were fine and the next day you can't get out of bed, they'll use your own words to argue your injuries "aren't from the accident." Never describe your health before a doctor has examined you.

2. "It was my fault" — or even "I'm sorry"

In our culture we apologize on instinct, even when we did nothing wrong. A simple "sorry" at the scene or on the phone can be recorded and used as an admission of fault. Fault is decided by evidence and the law, not by a nervous apology. Don't admit fault or guess about who was to blame.

3. "Sure, you can record my statement"

The adjuster will ask permission to record a "quick statement." It sounds harmless, but they're trained to ask questions that lead you to contradict yourself or downplay your injuries. You are not required by law to give a recorded statement to the other driver's insurance. You can — and should — say you'll speak with an attorney first.

4. "I'll take that" (accepting the first offer)

The first offer is almost always low, and it comes fast on purpose: before you know the real cost of your therapy, your car, and your missed work. Once you sign and accept, you can't reopen the claim even if your injuries get worse. Don't name a number or accept anything until you know the full extent of your damages.

5. "I think...", "it was probably..." (guessing at details)

If you don't remember something for certain — how fast you were going, the exact time, how far away you were — don't make it up. A guessed detail that later doesn't match the evidence makes you look unreliable. It's perfectly fine to say "I'm not sure, I'll have to check." Truth and precision protect you.

So what SHOULD I say?

Keep it short and honest: give your name, confirm there was an accident, and say you'll be in touch through your attorney. Nothing more. Save everything — photos, reports, medical bills — and let someone on your side deal with the insurance company for you.
